			<content:encoded><![CDATA[If racism is wrong, James J. Kilpatrick is in hell:<blockquote>When Brown v. Board of Education was decided in 1954, a remarkable number of Southern leaders quietly expressed a willingness to comply. As segregationists, they weren't pleased; but the rule of law called for obedience to the Court.<br /><br />A few, the most dedicated racists, would have none of it. "Segregation today, segregation tomorrow, segregation forever!" George C. Wallace memorably proclaimed. Wallace was a vulgarian; but the intellectual leader of the "segregation forever" movement was James J. Kilpatrick. Using the editorial columns of The Richmond News Leader, he made Virginia and then the South too hot to hold any white leader who talked of compromise. <br /><br />Kilpatrick supplied a constitutional theory to justify defiance, and it is one that will seem familiar to anyone who follows the Tea Party movement today. The Supreme Court's interpretations of the Constitution were wrong--not just in Brown, he explained, but ever since 1803. "The sovereign states," not individuals, were the only important citizens of the Union. When the federal government, or the Supreme Court, overstepped its bounds, states could simply "interpose" their authority and nullify their orders. The Fourteenth Amendment (which was probably not valid anyway) did not provide for racial equality. The Tenth Amendment guaranteed state "sovereignty." The United States of 1954 was the United States of John C. Calhoun, "unchanged by John Marshall, unchanged by the Civil War, not altered in any way since the Constitution was created in 1787."<br /><br />Kilpatrick's concern was not simply purity of principle though; he was frank to say it was the purity of the white race. "What has man gained from the history of the Negro race?" he wrote in 1957. "The answer, alas, is 'virtually nothing.'" When the founders of the segregationist Prince Edward Academy fell short in assembling a library needed for state accreditation, Kilpatrick donated his own books to make sure that the all-white school could open on schedule. As late as 1964 he wrote an article for The Saturday Evening Post arguing that "the Negro race, as a race, is in fact an inferior race." Mercifully, in view of violence against black people in the South, the editors spiked this piece.<br /><br />Which brings us to Kilpatrick's legacy. "Kilpatrick, by propagating a whole vernacular to serve the culture of massive resistance -- interposition, nullification, states' rights, state sovereignty -- provided an intellectual shield for nearly every racist action and reaction in the coming years," Pulitzer Prize-winning authors Gene Roberts and Hank Klibanoff wrote in their 2006 book, The Race Beat. </blockquote>And hell isn't segregated either . . . They attempt to circumvent it by using the kind of phony legal arguments cooked up by James J. 			<content:encoded><![CDATA[Borrowing a theme from the far right wing, blogger Ben Tribbett has launched an all out attack against U.S. Senator Mark Warner:<blockquote>What the hell is he thinking?<br /><br />I've been to this once a year event (probably 10 times over the years) and it's a great party.  But why would Mark Warner have his annual Pig Roast on September 11th this year?  The large pig being carved up, the hay rides, and a big party across his lawn and around the pool just doesn't seem appropriate for the 9th anniversary of the September 11th attacks on New York and Virginia.  <br /><br />I'm going to call Senator Warner's office first thing in the morning to find out about this.  For now, all I can say is this.  If Mark Warner's political judgment is that this kind of party is acceptable on 9/11, then I am very grateful that he didn't run for and wasn't elected President.</blockquote>You can read the original attack with links at <a href="http://notlarrysabato.typepad.com/doh/2010/08/mark-warners-911-pig-roast.html">Not Larry Sabato</a>.<br /><br />There are a couple of notable features to this story and at least one unanswered question.  The first is the grounds for the attack.  Tribbett--who claims to be a Democrat--has adopted the hardest of hard right arguments: that 9/11 is "sacred" day and you cannot hold any event on 9/11 other than commemorations of the attacks of September 11, 2001 on September 11th.  I wonder, has Ben Tribbett ever made the same argument in regard to December 7th?  I suspect that any number of Christmas parties have been held on December 7th over the years.  Why no 12/7 outrage?<br /><br />The second is the choice of target: Mark Warner.  A quick Google search for events will reveal that there are literally thousands of individuals and organizations holding events on September 11, 2010.  Are all these people and organizations behaving inappropriately?  The young couples getting married, the 10K runs, the art walks, the picnics, the family reunions, the vegetarian food festivals, the triathlons, the airshows(!), and all the other events being held on September 11th this year that have nothing whatsoever to do the 9/11 attacks: are all these people guilty of not observing the 9/11 anniversary?<br /><br />Since when in this country do we let terrorists dictate what we do and when we do it.  It is Ben Tribbett who is acting inappropriately in this matter.  Which leads to the unanswered question I referred to above.  <br /><br />What is Tribbett's underlying motive for this attack on Mark Warner?<br /><br />I've never bothered to attend Mark Warner's pig roasts in the past. Up until now, News Corp and Fox News have been able to maintain the fiction that they are not partisan and that their coverage is "fair and balanced."  This donation finally and definitively gives the lie to these claims. Many pro-"nullification" commenters have been pasting in boiler-plate arguments that cite Thomas Jefferson saying that "nullification" was a right of the states, so I thought it might be worth another short post to state the following in clear, unambiguous language:<br /><br />Thomas Jefferson did not participate in the writing of the U.S. Constitution nor was he ever a U.S. Supreme Court justice.  His opinions as to what the Constitution allows in terms of "nullification" powers as expressed in the Kentucky Resolutions (which he authored anonymously) is just that: a personal opinion with no force of law.<br /><br />On the other hand, the U.S. Supreme Court in <a href="http://therichmonder.blogspot.com/2010/08/cooper-v-aaron-358-us-1-1958.html">COOPER v. AARON, 358 U.S. 1 (1958)</a> ruled 9-0--a unanimous decision--that there is no such thing as "nullification."  No where does the word "nullify" or "nullification" appear in the U.S. Constitution or any of its amendments, including the 10th Amendment.<br /><br />Simply put: there is no such thing as "nullification."  It is a legal fantasy.  The fact that it was a legal fantasy authored by Thomas Jefferson gives it no more legal power than the legal fantasies of any other philosopher or fantasist.<div class="blogger-post-footer"><img width='1' height='1' src='https://blogger.googleusercontent.com/tracker/19190919-3613311854492922780?l=therichmonder.blogspot.com' alt='' /></div>]]></content:encoded>

Ken Cuccinelli took his eye off the ball and failed to keep up with a civil case against the Commonwealth of Virginia ad James Madison University.<blockquote>The Commonwealth of Virginia has defaulted on a lawsuit.<br /><br />You read that right. The commonwealth, along with James Madison University, has defaulted on a tortious interference case in New York. We’ll know next week how much it’s going to cost you and me.<br /><br />Here’s what happened: A guy named Matthew Brady was the men’s basketball coach at Marist College in Dutchess County, N.Y., for four years. He had a contract with Marist that ran through 2011.<br /><br />He took a job with JMU. According to the lawsuit Marist filed, JMU and the commonwealth tortiously interfered with that contract. Also, Brady went after some of the kids he had recruited for Marist, which was an alleged breach of fiduciary duty to Marist, “intentionally induced” by JMU, according to the suit.<br /><br />Procedurally, Marist filed in state court, the case was removed to federal court, where JMU and the commonwealth answered and filed number of pleadings to get the suit kicked. The suit was remanded to state court. Marist moved for default a few months after the suit was back in state court.</blockquote>Read the entire story with links at <a href="http://valawyersweekly.com/publishers-blog/2010/07/20/the-commonwealth-defaults/">The Publisher's Notebook</a>.<br /><br />Odd thing is that during the period of time when Cuccinelli's office was supposed to be defending James Madison University against this lawsuit, Ken Cuccinelli was instead sending JMU a letter telling them that it was not okay for Virginia's public universities to have non-discrimination policies that protected gays from discrimination.  The long and short of it is that Ken Cuccinelli has been playing politics instead of doing his job.<br /><br />How serious is it to have a default judgement?  For the defendant, a default judgement may not be all that serious: a default can often be set aside by the court.  For the lawyer or lawyers who caused the default, it could serve as the basis of a claim of malpractice.  Ken Cuccinelli has clearly been too distracted by playing politics and not paying attention to his job.  Maybe this incident will cause the attorney general to reconsider where he focuses his attention going forward and stop neglecting the actual duties of his job.<div class="blogger-post-footer"><img width='1' height='1' src='https://blogger.googleusercontent.com/tracker/19190919-165749427819961854?l=therichmonder.blogspot.com' alt='' /></div>]]></content:encoded>

The day after the wedding I had some time to explore San Diego's waterfront while I waited for the red-eye flight I'd scheduled to save money.  I checked my bags, grabbed my camera, and walked down to see the <a href="http://en.wikipedia.org/wiki/USS_Midway_Museum">U.S.S. Midway Museum</a>.<br /><br /><a href="http://2.bp.blogspot.com/_UJYbd5G4f6Y/TGnxYdgBR_I/AAAAAAAADf8/UCCfBQfG3RQ/s1600/flight+deck-2.jpg"><img style="margin:0px auto 10px;text-align:center;cursor:pointer;cursor:hand;width: 400px;height: 266px" src="http://2.bp.blogspot.com/_UJYbd5G4f6Y/TGnxYdgBR_I/AAAAAAAADf8/UCCfBQfG3RQ/s400/flight+deck-2.jpg" border="0" alt="" /></a>The scale of this vessel is amazing, so much so that without my 55-200mm telephoto lens and a proper vantage point, I was unable to get a good picture of the entire ship, so the first photo you see is not one of mine.  It is a photo of the <a href="http://en.wikipedia.org/wiki/CV-41">U.S.S. Midway</a> taken by Photographer's Mate 1st Class Arlo K. Abrahamson back in 2004 during the <a href="http://en.wikipedia.org/wiki/CV-41">Midway</a>'s decommissioning. While <a href="http://en.wikipedia.org/wiki/CV-41">Midway</a> is already home to an impressive collection of aircraft, her collection could be doubled without seriously crowding the hangar. 		<description><![CDATA[The 5th Congressional District Tea Party may have struck again.  The Republican candidate in the 5th, Robert Hurt, was apparently the target of a "white powder" attack.  Democratic incumbent Tom Perriello condemned the attack.  Perriello of course has good reason to be concerned by extremists, having already been their target once before:<blockquote>"If this was meant to be a threat, and particularly if it was in any way politically motivated, I hope the cowards behind this will be caught and prosecuted to the full extent of the law," the statement said.<br /><br />Perriello is no stranger to incidents of political intimidation.<br /><br />In March, tea-party supporters posted what they thought was Perriello's Charlottesville address online so opponents could "drop by" and "express their thanks" for his vote in favor of health-care reform.<br /><br />The address was actually his brother's and the following day a gas line to an outdoor grill on the porch was cut at the house. Local officials deemed the incident "a deliberate act of vandalism" that could have posed a danger.</blockquote>The 5th District Tea Party denied all connection with the attack on Perriello's brother's family home.  It should be noted that Robert Hurt is not the Tea Party's preferred candidate in the 5th, and recently Hurt refused to debate Periello and his Tea Party challenger Jeff Clark.  <br /><br />Did one of Clark's disappointed supporters decide to seek revenge? Many Southerners experience cognitive dissonance when they approach this subject. On the one hand, we are surrounded by monuments tot he courage and sacrifice of Southern fighting men. Southern generals, particularly in the eastern theater, demonstrated a mastery of defensive tactics--Robert E. Lee won more than one battle against overwhelming odds of two and nearly three to one. Is it really possible that so much courage, so much skill, and so much sacrifice could be poured out for the ignoble cause of preserving slavery?<br /><br />Many Southerners cannot resolve the courage of Southern fighting men with the base motives of the Southern political elite, and so they construct elaborate justifications for the actions of the South in late 1860 and early 1861. It is wasted effort on their part. The inescapable reality is that slavery was the primary--very nearly the solitary--motivating factor behind the actions of the Southern ruling elite.<br /><br />While the average Southerner may not have owned slaves, the average member of the Southern ruling elite owned several. Then as now, the very wealthy exercised disproportionate influence over society. Much as large corporations and oil companies use their influence to benefit their interests today, the large slave owning planters of the Deep South manipulated Southern politics to protect their "right" to own negro slaves.<br /><br />Mr. Bryan rightly points to the documentary evidence from the period to support his argument. Slavery was woven into the very fabric of the new republic Southern leaders were trying to construct.<br /><br />As the war progressed and the reality that for Southerners it was a "rich man's war and a poor man's fight" sank in, the South suffered from a crippling rate of desertion as poor whites "voted with their feet." 		<description><![CDATA[<br /><br />Republicans love to cook up scary stories they can then use to terrorize Americans into voting for them.  It's also pretty rare these days for a journalist to do a little digging to find out whether these stories are true.  Usually the Republican is invited on a cable television where he is allowed to tell his lie, then a moderate--who is supposedly representing the Democratic viewpoint--offers an unconvincing rebuttal, and then the host of the show sort of shrugs and invites people to make up their own minds.<br /><br />That's not what happened last night on Anderson Cooper 360.  Last night, Anderson Cooper called out Representative Louie Gohmert for spreading the false "terror babies" story on the floor of the House of Representatives.  Caught in a lie, Gohmert flips out and goes on a rant for several minutes.  Cooper gave the congressman ample opportunity to supply real evidence for the "terror babies" story, but because it's a lie concocted by Republicans to scare people Gohmert was unable to offer any evidence.<br /><br />That's the Republican Party for you.<div class="blogger-post-footer"><img width='1' height='1' src='https://blogger.googleusercontent.com/tracker/19190919-2815635380643185616?l=therichmonder.blogspot.com' alt='' /></div>]]></description>

If this had been a Mexican illegal alien, conservatives would be lighting up the internet with calls to close the border with Mexico.  I wonder if this means the Republican Party will call for a reduction in the number of visas granted to Israelis? 		<description><![CDATA[Yesterday, Senator Donald McEachin (D - 9th) released a statement in which he cited <a href="http://caselaw.lp.findlaw.com/scripts/getcase.pl?navby=CASE&#38;court=US&#38;vol=358&#38;page=1">COOPER v. AARON, 358 U.S. 1 (1958)</a> to support the assertion that states and state elected officials do not have the ability to "nullify" federal laws and the pronouncements of federal courts.<br /><br />A handful of conservative and/or Republican commenters persist in the error of believing that nullification is a valid legal theory.  It is not, and those who doubt it would do well to read the unanimous decision of the U.S. Supreme Court in the case of <a href="http://caselaw.lp.findlaw.com/scripts/getcase.pl?navby=CASE&#38;court=US&#38;vol=358&#38;page=1">COOPER v. AARON, 358 U.S. 1 (1958</a>).  A couple of key quotes from the case:<blockquote>In short, the constitutional rights of children not to be discriminated against in school admission on grounds of race or color declared by this Court in the Brown case can neither be nullified openly and directly by state legislators or state executive or judicial officers, nor nullified indirectly by them through evasive schemes for segregation whether attempted "ingeniously or ingenuously."</blockquote>The court then goes on to issue a warning:<blockquote>No state legislator or executive or judicial officer can war against the Constitution without violating his undertaking to support it. Chief Justice Marshall spoke for a unanimous Court in saying that: "If the legislatures of the several states may, at will, annul the judgments of the courts of the United States, and destroy the rights acquired under those judgments, the constitution itself becomes a solemn mockery . . .</blockquote>It was therefore appropriate for Senator McEachin to cite COOPER v. AARON in his statement, and Governor McDonnell would do well to take note of this case.  When Governor McDonnell flirts with nullification he flirts with "violating his undertaking to support" the U.S. Constitution. Madison gave the Supreme Court the final power of judicial review, then all states are bound by federal law and bound by Supreme Court decisions.<br /><br />“But even if the Governor has forgotten these Constitutional law principles, he should surely recall the amount of blood spilled, families and homes decimated and young men killed the last time states made foolish decisions based on nullification. 		<description><![CDATA[Traditionally, the office of the Attorney General of Virginia has been seen as somewhat above politics.  While all elected attorney generals are politicians, they all try to at least present the appearance of being somewhat non-political during the first three and a quarter years of their terms.  It is also a venerable tradition that the Attorney General of Virginia resign once they begin actively campaigning for their next elective office.  <br /><br />The reason for this is obvious: to keep parties to disputes from trying to influence the attorney general by making political contributions to them while they are still in office.  Bob McDonnell honored this tradition when he stepped down last year to run full time for the office of governor.<br /><br />Ken Cuccinelli has admitted that he is already actively campaigning for his next office, so by Virginia tradition he needs to step down from his office as attorney general.  Too many of his actions have been nakedly political already and have been explicitly designed as part of solicitations for campaign funds.  Cuccinelli is violating Virginia tradition by using his authority as attorney general to actively fundraise while in office.  He must resign or cease fundraising activities that are explicitly tied to his duties as attorney general.<br /><br /><br /><br />By his very own admission, Cuccinelli is actively campaigning.  He is violating Virginia tradition that he as a conservative ought to respect.
