			<content:encoded><![CDATA[Yesterday, U.S. District Court Judge Virginia A. Phelps overturned Don't Ask, Don't Tell after a trial, finding that allowing gays to serve does not damage military readiness.  She used in her decision the practice of deploying people who were already under investigation and then moving with their discharges after they returned from battle.  She will issue an injunction today enforcing her ruling.<br /><br />Will that injunction be effective immediately?  I doubt it.  The Servicemembers Legal Defense Network already has a case in progress.  They argued that DADT is unconstitutional on First and Fifth Amendment grounds in light of Lawrence v. Texas, which made consensual sodomy legal.  That case, Cook v. Casey, was unsuccessful and the First Circuit Court of Appeals affirmed the lower court because it found that national command authorities deserve great deferrance in the area of military readiness.  Of course, the plaintiffs  in Cook did not challenge the readiness aspect of the law, so yesterday's decision certainly upsets the apple cart for the United States Government.<br /><br />Will the Department of Justice appeal this decision?  Considering that there is a conflicting Circuit Court decision, it pretty much has to.  Indeed, the Government did not challenge the readiness agrument (factually, it really could not, since the Pentgon does what the plaintiffs allege) because it relied on the First Circuit's jurisdicational ruling.  If the Ninth Circuit agrees with the Government, the case dies and the only hope for repeal is for one Republican member to vote to allow the Defense Authorization bill to come to a vote in the Senate and for all amendments to the managers language (which mirrors the House language repealing DADT) remains intact. If the bill passes and is signed, the President, Secretary of Defense and Chairman of the Joint Chiefs must certify that DADT repeal can go forward, with repeal effective 60 days later.  Since nothing is certain, it would be better for yesterday's ruling to stay intact - if only as a safety valve.<br /><br />If the Ninth Circuit affirms the District Court on Appeal, then two circuits will be in disagreement, which will fast track both cases for the Supreme Court.  The Office of the Solicitor General is currently in opposition to having the Supreme Court hear Cook v. Gates, in an opinion signed by then Solicitor General Elena Kagan, however they will certainly change their minds if the Ninth Circuit disagrees with the First.  Indeed, I suspect that all consideration of the Writ of Certiori, which is legalese for a decision to hear the case, will be held up while the Ninth Circuit hears the case.  Cert takes four votes and because Kagan signed the motion to deny it in Cook, she will likely recuse herself - which is why the Ninth Circuit affirming the District is important if the Senate removes DADT repeal from the Defense bill.  If DADT is not repealed and the Ninth Circuit affirms the First Circuit, then Roberts, Alito, Scalia, Thomas or Kennedy must agree to hear the case.  This is possible, but not likely.<br /><br />If DADT is repealed in the bill and the President, et al, certify that it should be, the case would be moot.  Indeed, before briefs could even be filed before the Ninth Circuit (and the timing is up to the Justice Department), the Defense bill will likely be passed with or without repeal language.  If I were the Acting Solictor General, I would stretch that decision out as long as possible, while asking for a stay of the injunction until any appeal has taken place or until Congress acts.  Indeed, I would expect all parties will move to dismiss all appeals in all courts, since DADT would then be gone.<br /><br />The case is mostly valuable as leverage at this point, although it could also be used by weak Democrats to justify acting - so it is a double edged sword at this point. <p>In a Whistleblower suit, a private citizen can sue on behalf of the US government with and allegation of Fraud.  If successful, the private citizen gets 30% of the reward.  The government can intervene and either take over the suit or quash it if it wishes.</p>
<p>The question I have is quite simple.  Has Landis-whom crushed my heart when his 2006 TdeF title was stripped due to failing drug tests-had a legitimate change of heart in his approach to and acceptance of drug testing?  Or is this another scam being pulled by a guy who got over $1,000,000.00 from fans to fund his defense fund as he tried to fight off doping charges&#8230;only to confess to doping?</p>

<p>Summer  is officially over. School is back in session. And, Back To School  Nights will be starting soon along with fall activities and homecoming  parades and games.</p>
<p>                                                  With school beginning anew, I am reminded of  an Albert Einstein quote:  &quot;The significant problems we face cannot be  solved at the same level of thinking we were at when we created them.&quot;   We must strive to think critically with new insights and experience to  make continued improvements to our community and government.</p>
<p>                                                  That  is why I have convened three advisory groups on Education, Environment  and Mental Health. There are significant issues in each of these areas,  all of which I am passionate about and all of which need novel  approaches to make needed changes. I look forward to constructive  thinking and collaborative discussions.</p>
<p>                                                  In addition, I am  welcoming suggestions for legislation for the 2011 Session, including:  proposed legislation, budget amendments, special events or people who  deserve to be commended by the Commonwealth.</p>
<p>                                                  My next Community Drop-In Hours session is this <strong>Thursday, September 9</strong>, <strong>from 1 pm to 3pm, at the Woodrow Wilson Library</strong> Conference Room, 6101 Knollwood Drive, Falls Church.  I am delighted to  be joined by two School Board members on Saturday: Sandy Evans, Mason  District, and Patty Reed, Providence District.</p>

<p>                                                The  DMV, Board of Elections and Department of Taxation were unable to fully  conduct daily business, and more importantly, to provide the services  Virginians depend upon due to a major computer outage that lasted for  more than 8 days.</p>
<p>                                                After recently extending and expanding the now  $2.4 billion computer systems contract with Northrop Grumman and giving  full oversight authority to the Virginia Information Technology Agency  (VITA), such performance is simply unacceptable. </p>

<p>More  than 3,200 Virginia residents were waiting to renew or receive their  drivers licenses and countless others have been prevented from receiving  social services as well as juvenile and criminal justice services. </p>
</p></div>

<p>I commend and thank the Fairfax County Police Department for agreeing not to ticket drivers who could not renew their licenses.</p>

<p><img src="http://www.workworld.org/wwwebhelp/images/tanf.gif" align="left" height="92" hspace="5" vspace="5" width="112" />The  Temporary Assistance for Needy Families Emergency Fund, which is now  awaiting Congressional action, is set to expire September 30, 2010.</p>
<div>
<p>Congress  should take action soon to provide additional funding for next year. I  have sent Senators Warner and Webb and Congressman Connolly an urgent  letter asking for their active leadership and immediate support.</p>
<p>                                                Since  April of this year, more than 700 Fairfax County families have received  direct assistance for utilities, rent and basic needs and 52 people  have been able to take advantage of subsidized employment  opportunities.  </p>
<p>                                                According to CLASP, an advocacy group for low-income people, Virginia could receive over $47M in funding under HR 5893. <a href="http://r20.rs6.net/tn.jsp?llr=nbs9yycab&amp;et=1103667130263&amp;s=849&amp;e=001StNtQlPxa_KvBr-4x0fG1t9ff0GB44pJjzZXIkGCWYsaxKeAsFVqziiDeSrBtmgp1-phhTUYhNcjejnRh59xRJ07rV133cRelFnIQi3SD9Jhmov70spPDQKSLzQFXe6JcbPydMcw5TTF1pLoQpe__iQt16ImY_9CYDt3QNEFL5GJcNGfCxVAMg==" ><strong><em>Click Here for more Information and to Act Now.</em></strong></a> </p>

<p>When we talk about the impressive ability of the United States to transfer political power every four/eight years, we call it impressive because we presume it involves introducing some change that the exiting party opposes.  And the entire point of elections is to provide an opportunity to introduce that change.  So, in that context, I ask &#8211; how in the hell did we <a href="http://www.washingtontimes.com/news/2010/sep/9/obama-uses-bush-plan-for-terror-war/">end up here</a>?</p>
<blockquote><p>On issues ranging from the government&#8217;s detention authority to a program to kill al Qaeda terrorist suspects, even if they are American citizens, Mr. Obama has consolidated much of the power President George W. Bush asserted after Sept. 11 in the waging of the U.S. war against terror.</p>
<p>[ . . . ]</p>
<p>Overall, [former CIA Director and Bush appointee] Mr. Hayden said, there is more continuity than divergence between the Bush and Obama administrations&#8217; approaches to the war on terror.</p>
<p>&#8220;You&#8217;ve got state secrets, targeted killings, indefinite detention, renditions, the opposition to extending the right of habeas corpus to prisoners at Bagram [in Afghanistan],&#8221; Mr. Hayden said, listing the continuities. &#8220;And although it is slightly different, Obama has been as aggressive as President Bush in defending prerogatives about who he has to inform in Congress for executive covert action.&#8221;</p></blockquote>
<p>I never thought that Obama (or any president) would willingly give up the expanded state surveillance powers, but I have to admit to being surprised that he&#8217;s put so much effort into <a href="http://www.salon.com/news/opinion/glenn_greenwald/2010/09/08/obama/index.html">protecting torturers</a>:</p>
<blockquote><p>In <a href="http://www.salon.com/news/opinion/glenn_greenwald/2010/09/08/obama/JEP_EN_BANC.pdf">a 6-5 ruling issued this afternoon</a>, the 9th Circuit Court of Appeals handed the Obama administration a major victory in its efforts to shield Bush crimes from judicial review, when the court upheld the Obama DOJ&#8217;s argument that Bush&#8217;s rendition program, used to send victims to be tortured, are &#8220;state secrets&#8221; and its legality thus cannot be adjudicated by courts.</p>
<p>[ . . . ]</p>
<p>The distorted, radical use of the state secret privilege &#8212; as a broad-based immunity weapon for compelling the dismissal of entire cases alleging Executive lawbreaking, rather than a narrow discovery tool for suppressing the use of specific classified documents &#8212; is exactly what the Bush administration did to such extreme controversy.</p></blockquote>
<p>This is exactly what Candidate Obama decried.  And now President Obama has completely embraced it.  This isn&#8217;t some small matter of little interest to those outside of the legal or political worlds.   The ACLU&#8217;s Ben Wizner, who argued the case, said:</p>
<blockquote><p>This is a sad day not only for the torture victims whose attempt to seek justice has been extinguished, but for all Americans who care about the rule of law and our nation&#8217;s reputation in the world. To date, not a single victim of the Bush administration&#8217;s torture program has had his day in court. If today&#8217;s decision is allowed to stand, <strong>the United States will have closed its courtroom doors to torture victims while providing complete immunity to their torturers.</strong></p></blockquote>
<p>I&#8217;d like some of that Change We Can Believe In, please.</p>

		<title>Another Little Neocon Reality</title>

			<content:encoded><![CDATA[<img align=left src="http://i59.photobucket.com/albums/g293/ewtglant/Airacobra_P39_Assembly_LOC_02902u.jpg">Tax cuts disguised as economic stimulus (i.e. deficit spending) by Republican administrations won't do much to stimulate our economy anymore. Deficit spending in its intended form will. The cause is the neo-economy of the neo-conservatives. Tax cuts stimulate China's economy. Deficit spending on infrastructure and American goods stimulates ours. <p>There was a time not too long ago when data on inventories was a leading economic indicator. It isn't discussed a lot anymore. It really doesn't portend so much for the American economy today. In those good old days, low inventories meant that orders were on the horizon and that meant firing up production in the United States, putting the un- and under-employed back to work. That was when the products being sold at retail were substantially domestically produced. Today, low inventories in the United States are good news overseas. The lag in and the magnitude of a response to economic stimuli have been compromised by globalization. <p>This means that if we want to have anything to show for all these deficits, after all the crying is over, we had best direct the spending toward something enduring, like infrastructure; something that puts the most Americans back on payrolls paying taxes. If we want to rely on supply side side-effects to revive the economy, just be aware that our supply side is turning into service at the retail counter. If supply side voodoo worked, it would be working in China and elsewhere and a lag would follow before it had any impact here. &nbsp; <br /> While the multiplier effect of private spending is significantly greater than that of public spending, that result occurs in a closed system. The United States no longer qualifies as that microcosm; it may have only been so during early industrialization and then during World War II. There is no good method to measure how much of the private multiplier washes back to the United States (it probably still is 5, while public spending hovers at 1), but in a global environment most of that is absorbed as growth in the producing economies. <p>That is why tax cuts creating deficits are not as effective as deficit spending directed at infrastructure. Increasing the discretionary income in the American economy results in purchases of goods and services that do not add to the capital structure of the United States. In fact, an argument can be made that purchasing a service may result in a lower multiplier than public spending. After all, many services have no, or even a negative, residual value after they have been consumed (as in any black market, thus untaxed transaction).<p>At least when government builds a road (in the United States, not Afghanistan) or high speed rail, there is evidence of economic activity and a residual capital asset; a resource. Or when a bail-out of an American industry keeps production in the United States, there's a chance that domestic purchases may cause an immediate ripple in our own economy. One of the wacko wing talk show hosts constantly argues that the wealthy need the tax cuts so that they can eat out and leave good tips to stimulate the economy. I would argue that that kind of transaction results in no better multiplier than public spending and less when they go un- or under-reported (which they often do). <p>But the voodoo-economists of the portray-a-patriot set are not invested in the United States. They are proudly invested in their own self-interests (a misrepresentation of Ayn Rand's philosophy). And unfortunately (because I enjoy paying taxes as much as anyone) tax cuts (particularly for the wealthy) are going to stimulate the black market and overseas economies, not so much, America's. &nbsp;]]></content:encoded>

When neighbors complain about "noise," you have to wonder what standard they're using. Are they balancing what's easily-ignored with what's actually loud? Or are they saying, "It was completely silent before, now I can hear something, therefore I'm calling the authorities"?<br />

Got this <a href="http://www.facebook.com/photo.php?pid=14791680&amp;o=all&amp;op=1&amp;view=all&amp;subj=116869491701425&amp;id=897570500#!/MilesGrant?v=wall&amp;story_fbid=152148508145785&amp;ref=mf">response</a> to my post from Maureen Dilg, writing on behalf of the Arlington County Office of Communications (reprinted here in its entirety):<br />

Westover Market has appropriate approvals for seasonal outdoor seating  for nine people. Having live, musical entertainment requires a  public hearing before the Arlington County Board.  Should Westover  Market choose to apply for a Live Entertainment Use Permit, the County  Board will weigh measures that will minimize the adverse impacts of its  use on its neighbors.</span><br />

<span class="text_exposed_show" style="font-family: Times,&quot;Times New Roman&quot;,serif;">All Arlington County residents and  businesses are expected to comply with the requirements of local  ordinances.</span></blockquote><span class="text_exposed_show">I appreciate Ms. Dilg's response, but according to TBD.com, she's not telling the whole story here. Westover Market did <a href="http://www.blogger.com/%20http%3A//www.tbd.com/blogs/tbd-neighborhoods/2010/09/live-music-at-kid-friendly-beer-garden-draws-complaints-1406.html">apply for a permit</a> to seat up to 24, but the county denied it on the grounds that the bathroom was insufficient. So, to review:</span><br />
<ul><li><span class="text_exposed_show">Cite business for seating more than 9 people</span></li>
<li><span class="text_exposed_show">When said business applies to seat more, deny it</span></li>
<li><span class="text_exposed_show">When people complain about you harassing a business for doing well, say they don't have the right permit, which you denied</span></li>
<li><span class="text_exposed_show">Repeat</span></li>
</ul><span class="text_exposed_show">But as I said in my first post, I understand the zoning regulations &amp; don't dispute Westover Market needs to meet them. The question is, do you work with the business that's clearly tapped a niche in the community (the Facebook group is approaching 300 members at this writing) to keep a good thing going? Or do you shut down the live music effective immediately &amp; force them through a regulatory <a href="http://www.runnerspace.com/members/images/21/2685_full.jpg">steeplechase</a>?&nbsp;</span><br />

<span class="text_exposed_show">Arlington County has clearly chosen the latter. Nine people on the patio sitting quietly? Fine. Ten  people on the patio with toddlers dancing to Jack Johnson covers? HAVE SOME COUNTY BOOT ON THE BACK OF YOUR NECK, HIPPIES.</span><br />

As TBD reported, there's a <a href="http://www.tbd.com/blogs/tbd-neighborhoods/2010/09/live-music-at-kid-friendly-beer-garden-draws-complaints-1406.html">question of community character</a> at stake:<br />

Barbara Johns, at the age of 16, led her classmates at Moton High School in Prince Edward County to protest segregation in Virginia's schools. Her action led to a lawsuit that was eventually incorporated with three other cases into Brown vs. Board of Education. <br /></p>

<blockquote><p>U.S. District Judge Virginia Phillips granted a request for an   injunction halting the government&#8217;s &#8220;don&#8217;t ask, don&#8217;t tell&#8221; policy for   gays in the military.</p>
<p>Phillips said the policy doesn&#8217;t help military readiness and instead  has  a &#8220;direct and deleterious effect&#8221; on the armed services.</p></blockquote>
<p>In a <a href="http://online.logcabin.org/news_views/reading-room-back-up/dont-ask-don-t-tell-legal-action/statement-on-log-cabin.html" >statement</a>, the Log Cabin Republicans celebrated the ruling.</p>
<blockquote><p>“As an  American, a veteran and an Army reserve officer, I am proud the court  ruled that the arcane Don&#8217;t Ask Don&#8217;t Tell statute violates the  Constitution,” said Log Cabin Republicans Executive Director R. Clarke  Cooper.  “Today, the ruling is not just a win for Log Cabin Republican servicemembers, but all American servicemembers.”</p></blockquote>

<p>With this ruling (<a href="http://www.politico.com/static/PPM170_100909_logcabin.html" >here</a>), the ball is clearly in the court of the Obama administration. Will the U.S. Justice Department appeal &#8211; and run the risk of (further) angering the LGBT community? If I had to guess, I&#8217;d have to answer that question in the affirmative.</p>

A few comments. 1) What's a "Jourolista?" Maybe he means <a href="http://en.wikipedia.org/wiki/Journalista!">"Journalista"</a>, a "daily news blog about the comics industry?" (sarcastic LOL) That seems more appropriate. 2) Does Cooch realize that the "individual mandate" was first proposed by <i>Republicans</i>, including <a href="http://www.huffingtonpost.com/2010/03/29/individual-mandate-now-vi_n_517097.html">George HW Bush</a>, as a way to "encourage and empower" individuals? My, how times have changed. 3) Is Cooch on the edge of sanity or what? Does he really believe that getting rid of preexisting conditions and the "donut hole" constitutes "federal tyranny?" If so, he's completely bonkers (and a fanatic), but whatever, we knew that already. 4) Yes, we'd love to bring him down. That's putting it simply! &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;<p>The Washington Times concluded by saying, <b>"Ultimately, it is the people's own individual sovereignty that is threatened by Obamacare.
